By accessing or using GoPave, you agree to be bound by these Terms. ## 1\. Company Information GoPave is operated by Rising Tide Creative LLC, a Tennessee limited liability company, doing business as GoPave, located at: 116 Agnes Rd, Suite 200 Knoxville, TN 37919 United States ## 2\. Eligibility You must be at least 18 years old and legally capable of entering into contracts to use the Services. ## 3\. Account Responsibilities You are responsible for: - Maintaining the confidentiality of your login credentials - All activity occurring under your account - Ensuring your use complies with all applicable laws ## 4\. Acceptable Use You may not use GoPave to: - Send spam or unsolicited messages - Send SMS/MMS without proper consent - Violate TCPA, CAN-SPAM, or carrier policies - Engage in illegal, deceptive, or fraudulent activities - Promote regulated or prohibited industries - Interfere with or disrupt the Services Violation may result in immediate suspension or termination. ## 5\. Messaging & Compliance Responsibility You acknowledge that: - GoPave is a technology platform only - You are solely responsible for consent, content, and compliance - A2P verification is required for SMS/MMS - Carrier fees and usage-based charges apply GoPave assumes no liability for your messaging practices. ## 6\. Subscriptions & Payments - Payments are processed through Stripe - Plans may be billed monthly or annually - Usage-based charges apply for messaging, telephony, email, and other metered services - Fees are non-refundable unless required by law - Failure to pay may result in service suspension ## 7\. Refund Policy All fees are non-refundable, including unused time or usage, unless otherwise required by law or explicitly stated in writing by GoPave. ## 8\. Intellectual Property GoPave and all related software, branding, and content are the exclusive property of Rising Tide Creative LLC. You are granted a limited, non-transferable license to use the Services. ## 9\. Data Ownership You retain ownership of your data. By using GoPave, you grant us permission to process your data solely to provide the Services. ## 10\. Service Availability The Services are provided "as is" and "as available." We do not guarantee uninterrupted or error-free operation. ## 11\. Termination We may suspend or terminate access: - For violations of these Terms - For non-payment - To comply with legal or carrier requirements You may cancel your subscription at any time. ## 12\. Limitation of Liability To the maximum extent permitted by law, GoPave shall not be liable for: - Indirect, incidental, or consequential damages - Loss of profits, data, or business - Compliance failures related to your use of the platform ## 13\. Indemnification You agree to indemnify and hold harmless GoPave and Rising Tide Creative LLC from any claims arising from your use of the Services or violation of these Terms. ## 14\. Arbitration & Governing Law These Terms are governed by the laws of the State of Tennessee. Any dispute shall be resolved by binding arbitration in Tennessee, except for claims eligible for small claims court. ## 15\. Changes to Terms We may update these Terms at any time. Continued use of the Services constitutes acceptance of the updated Terms. ## 16\.
